Reportable Conduct Penalties Now Apply

IN BRIEF: Penalties now apply for non-compliance with notification requirements under the reportable conduct scheme.

As CCER advised on 11 February, and operative since 1 June 2020, a failure to comply with new reporting timeframes under the reportable conduct scheme can now result in penalties.

Subject to certain exemptions after becoming aware of a reportable allegation, the ‘head of entity’ must provide details to the Office of the Children’s Guardian (OCG) within seven business days and investigate internally. If a final report is not provided to the OCG within 30 calendar days, an interim report must provide an update on the progress of the case, and an estimated timeframe for resolution.
