Clerks – Private Sector Award 2020 – Extension of Award Flexibility Provisions
CCER has previously advised of the flexibility provisions at Schedule I of the Clerks Award which was inserted as a response to the COVID-19 pandemic. The expiry date for these provisions has been extended on several occasions.
On 22 December 2020, the Fair Work Commission issued a decision further extending the operation of the provisions to 30 June 2021.
The Commission also made changes to the remote working provisions (formerly working from home) as follows:
- Remote work is defined as work undertaken by an employee from their home or any other location of their choosing that is not the premises of their employer.
- Employees and employers can agree that hours are worked non-continuously.
- Part-time employees may choose their start and finish times with agreement from their employer.
- The timing and configuration of meal or rest breaks can be flexibly applied, subject to the agreement of the employer.
The span of ordinary hours for remote work is unchanged ie 6am to 10pm Monday to Friday and 7am to 12.30pm on Saturday.
The existing provisions for an agreed temporary reduction in hours and the taking of annual leave are also unchanged.
